We can not afford to use our health care system as a "get rich quick" scheme for lawyers. We need "no-fault" medical compensation for adverse outcomes. States (and countries) that already have that in place have done well for patients and have done well for their health care systems so that all the dollars spent actually go toward health care. Medical malpractice is a scam that acts to greatly benefit lawyers, and rarely truly provides enough compensation for those injured in medical events, so that all their needs can be provided for. Medical malpractice needs to end in the US! We can not afford to drain more millions of dollars away from actual medical care and real compensation for patients that experience adverse events. We need compensation for patients to occur without lawyers getting rich. Physician negligence needs to be addressed by licensing boards.

Arresting officers will often pad on additional charges in an effort to make a suspect take a plea deal for one charge to have the rest dismissed. This tactic creates statistics that make the DA's office appear to be lenient when they are actually saving money by avoiding costly trials. If the DA's office took everything to trial with few dismissals and lost then Mr. Kensok would be saying the DA is wasting money with frivolous cases and had a disappointing conviction rate. POLITICS!!!

Cases are brought to the a filing deputy DA who at that point makes a determination what charges to file if any. Its not about an unlimited budget, its about justice. Over zealous prosecutors pursue cases knowing they can't prove it. The DA is probably the most powerful person in the county government. If the statistics demonstrate they are loosing cases at trial, then something has to change. Tom Is that person. His moral and ethical compass is absolutely in check. He has successfully prosecuted some of the most violent criminal in the state. He realizes his job as a prosecutor is not just to prosecute offenders, but to make sure justice is being served.
