NCTPA Soscol Gateway Transit Center Reimbursement Agreement:

 

Adopt a resolution approving a Public Improvements Reimbursement Agreement with in conjunction with their Soscol Gateway Transit Center Project.

Maintenance and Watershed Management Agreement:

 

Maintenance and Watershed Management Program Cost-Sharing Agreement with for Fiscal Year 2011-12.

Amendment No. 3 to Agreement No. 9843 with Pavement Engineering, Inc.:

 

Authorize the Public Works Director to execute Amendment No. 3 to Agreement No. 9843 with Pavement Engineering Inc. (PEI) in the amount of $50,000 to provide ongoing Pavement Management Program survey updates and general pavement engineering services.

Agreement for Access through City Property:

 

Adopt a resolution approving an agreement with Chappellet family for access through City property (APN 032-010-078) located in the Lake Hennessey watershed.

12.I.

Appropriation for Repairs due to Copper Wire Theft at Kennedy Park:

 

Adopt a Resolution approving a $40,000 appropriation using the Council Contingency Budget in the amount of $5,000 and the $35,000 balance to be funded by anticipated insurance reimbursement for repairs to the Ball Field electrical system due to the June 30, 2011 theft of copper electrical wire.

Council Direction to Proceed with Sale or Lease of Borreo Building and Confirmation of Proposal Evaluation Criteria for Future Use of Building:

 

Council will consider alternatives for disposition of the , including a possible sale or lease-option to purchase, and confirm key criteria for evaluating future use proposals

Ice Skating Rink use of City owned parking lot at the corner of 2nd and Coombs Streets:

 

Present a report to the City Council for review and direction regarding a proposed private, seasonal ice skating rink to be placed in a City owned parking lot at the corner of 2nd and Coombs Streets, which will require both permanent and temporary site modifications to accommodate this use.

Designation 2011 League of California Cities Delegate and Alternate:

 

Appoint a City Council delegate and up to two alternates to attend the League of California Cities Annual Business Meeting.

Administrative Report on AB 1178 (Ma) – Solid Waste Place of Origin:

 

Administrative report on Assembly Bill (AB) 1178 (Ma) seeking policy direction to staff to formally support, oppose or remain neutral on proposed legislation currently being considered by California legislature.

CHALLENGING DECISIONS OF CITY ENTITIES:  

The time limit within which to commence any lawsuit or legal challenge to any quasi-adjudicative decision made by any City Entity (including the City of Napa, the Napa Community Redevelopment Agency, or the Housing Authority of the City of Napa) is governed by Section 1094.6 of the Code of Civil Procedure, unless a shorter limitation period is specified by any other provision. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by any City Entity  must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred.

If a person wishes to challenge the nature of the above actions in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Napa, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies.
