Police Arrest Man on Alleged Third St. Assault

A 41-year-old homeless man punched and kicked a fellow transient in the face because he wouldn't throw away his beer can, police say.

Napa Police arrested a 41-year-old homeless man Sunday afternoon on suspicion of punching and kicking another man in the face over a dispute about the disposal of a beer can.

Police were called to the 1400 block of Third St. at around 12:30 p.m. Sunday on a report of an assault. The victim, a fellow transient, told police that 41-year-old James Edward Peters became angry with him when he refused to throw away his beer can for him. Peters then became angry with the man, who was sitting on the ground at the time of the alleged assault. Peters punched the man in the face and then stepped back and kicked him in the face multiple times, police said.

The victim sustained multiple injuries to his face, police said, but he refused medical treatment at the scene. Peters, who is on parole, fled the area before police arrived at the scene, but was later located at Pearl and Coombs streets.

Police arrested Peters on suspicion of felony assault and a hold on his parole was issued. He was booked into Napa County Jail.
