A 46-year-old Napa man was arrested Thursday night on suspicion of assault with a deadly weapon and violation of probation after police, following up on a reported street attack, saw him stealing a bicycle, according to a shift activity log from the :
Napa PD Officer were dispatched to a report of a fight that had just occurred near Lincoln Ave and Brown St with the involved parties leaving the area. The 41 yr old male victim was located near Third and Main St and alleged a male suspect approached him with a knife after an argument.
The victim disarmed the suspect and the suspect continued to attack the victim with an improvised impact weapon (a tube sock with a heavy object inside the sock). The victim had minor injuries as a result of the assault, but did not require medical attention. Evidence was developed that identified Luis Mariscal (3/12/66) as the suspect.
At approx. 2006 hrs SEU Officers located Mariscal near Jefferson and Lincoln Ave and kept him under surveillance. During this time Mariscal was observed stealing a bicycle from in front of . Mariscal was contacted by the officers and taken into custody. The bicycle was returned to its owner and Mariscal was booked into NCDC.
